8. Venue information and third-party services
Venue information, maps, travel times, routes, directions, ratings,
reviews, photographs, hours, and other details may be provided by
Apple Maps or other third-party services.
Mimble does not guarantee that a venue is open, available, safe,
accessible, affordable, appropriate, or able to accommodate your
group. Confirm important information directly with the venue before
traveling or making plans.
A venue’s appearance in Mimble does not necessarily mean that the
venue sponsors, endorses, or has a business relationship with Mimble.
Your use of Apple Maps, Firebase, Google advertising services,
navigation applications, venue websites, reservation services,
and other third-party services may be governed by additional
third-party terms and privacy policies.
9. Mimble AI and recommendations
Mimble AI and the Mimble Score help organize requests and rank
potential meeting places. Their results are generated suggestions
and are not guarantees.
Recommendations may be incorrect, incomplete, unavailable,
inappropriate, or unsuitable for a particular person or group.
You are responsible for reviewing the recommendation and verifying
important details before acting on it.
Mimble AI is not intended to provide legal, medical, financial,
safety, or other professional advice.
10. Voting and final decisions
Group votes, leader indicators, and the Make It Official feature
are planning tools. Mimble does not guarantee that every invited
participant has voted or agreed to the final selection.
Group organizers and participants remain responsible for confirming
the final destination, time, attendance, reservations, costs, and
other arrangements.
11. Advertising, sponsored listings, and deals
Mimble may display advertising, sponsored listings, promoted
businesses, or deals. Sponsored content will be identified with
labels such as “Sponsored,” “Ad,” or “Deal.”
Placement of sponsored content does not constitute a guarantee or
endorsement of a business, product, service, promotion, or offer.
Businesses are responsible for the accuracy, availability,
eligibility requirements, restrictions, expiration dates, and
fulfillment of their offers.
Mimble is not responsible for disputes between users and a
participating business unless applicable law requires otherwise.
12. Safety
Do not interact with Mimble while driving. Follow applicable traffic
laws and use an official navigation application for directions.
You are responsible for deciding whether a venue, route, meetup,
participant, or recommendation is safe and appropriate.
Use appropriate caution when sharing location information or meeting
people you do not know.
13. Ownership and intellectual property
Mimble, the Mimble name, logo, visual identity, software, source
code, design, functionality, original website content, and related
intellectual property are owned by Mimble, Inc. or its licensors.
Subject to these Terms, Mimble grants you a limited, personal,
revocable, nonexclusive, nontransferable right to access and use
the service for its intended purposes.
These Terms do not transfer ownership of Mimble or any Mimble
intellectual property to you.
14. Apple App Store terms
The Mimble application is made available through Apple’s App Store.
The application is licensed, not sold.
Unless Mimble provides a separate custom end-user license agreement
through the App Store, your license to use the iOS application is
also subject to Apple’s Standard Licensed Application End User
License Agreement and applicable App Store Usage Rules.
These Terms are between you and Mimble, not Apple. Mimble, not
Apple, is responsible for the Mimble application, its content,
maintenance, support, and claims relating to the application,
except where applicable law provides otherwise.
Apple has no obligation to provide maintenance or support services
for Mimble.
If the application fails to conform to an applicable warranty, you
may notify Apple, and Apple may refund any applicable purchase price
as provided by Apple’s terms. To the maximum extent permitted by
law, Apple has no other warranty obligation regarding Mimble.
Mimble, not Apple, is responsible for addressing claims relating to
the application, including product-liability claims, claims that the
application fails to comply with applicable legal requirements, and
consumer-protection or privacy claims.
If a third party claims that Mimble or your authorized use of Mimble
infringes that party’s intellectual-property rights, Mimble—not
Apple—is responsible for investigating, defending, settling, and
resolving that claim.
You represent that you are not located in a country or region subject
to a United States government embargo or designated by the United
States government as supporting terrorism, and that you are not
listed on a United States government prohibited or restricted-party
list.
You must comply with applicable third-party agreements when using
Mimble, including your wireless-data-service agreement.
Apple and its subsidiaries are third-party beneficiaries of these
Apple App Store provisions. Upon your acceptance of these Terms,
Apple will have the right to enforce these provisions against you
as a third-party beneficiary.
15. Suspension and termination
We may suspend, restrict, or terminate access to Mimble when
reasonably necessary to:
- Protect users, Mimble, or third parties.
- Prevent fraud, misuse, or security threats.
- Comply with legal obligations.
- Investigate a suspected violation of these Terms.
- Respond to conduct that violates these Terms.
You may stop using Mimble at any time. Provisions that logically
should survive termination—including ownership, disclaimers,
limitations of liability, and dispute provisions—will continue
to apply.
16. Disclaimers and limitation of liability
To the maximum extent permitted by applicable law, Mimble is
provided “as is” and “as available,” without warranties of any
kind, whether express, implied, or statutory.
We disclaim implied warranties of merchantability, fitness for a
particular purpose, title, and non-infringement.
We do not guarantee that Mimble will always be available, secure,
uninterrupted, error-free, or accurate, or that messages, votes,
recommendations, routes, venue information, calendar events, or
synchronization will always work as expected.
To the maximum extent permitted by law, Mimble and its directors,
officers, employees, contractors, affiliates, and licensors will
not be liable for indirect, incidental, special, consequential,
exemplary, or punitive damages; lost profits, opportunities, or
data; or harm arising from a meetup, venue, route, participant,
third party, advertisement, deal, or reliance on a recommendation.
To the maximum extent permitted by law, Mimble’s aggregate liability
for claims relating to the service will not exceed the greater of
$100 or the amount you paid directly to Mimble during the 12 months
preceding the event giving rise to the claim.
Some jurisdictions do not allow certain warranty exclusions or
limitations of liability. Those limitations apply only to the
extent permitted where you live.
17. Governing law, changes, and contact
These Terms are governed by the laws of the State of Florida,
without regard to conflict-of-law principles.
Any dispute not subject to another legally required process will
be brought in a court of competent jurisdiction located in Broward
County, Florida, unless applicable law requires otherwise.
We may update these Terms as Mimble changes. When we do, we will
update the effective date. Your continued use of Mimble after the
revised Terms become effective constitutes acceptance of the
updated Terms where permitted by law.
